Pilot version
Terms of use
These Terms describe the conditions for using Pactaris, a simple electronic signature platform operated by Firmaris Group. They apply to the restricted pilot version of the service and may be updated before general availability. By using the platform, you declare that you have read and understood what is written here. The Portuguese version is the reference in case of divergence.
1. The service
Pactaris lets a sender submit a PDF document for the electronic signature of one or more participants and follow its progress. In the current version, the service offers:
- upload of PDF documents up to 15 MB, with up to 10 participants per request, in simultaneous or sequential order and with a deadline from 1 to 90 days;
- an individual link per participant and confirmation by a one-time code sent to the e-mail provided;
- drawn or typed signature, with acceptance recorded, and the option to decline;
- a tracking dashboard, with filters and search, protected by password and a second authentication factor;
- an evidence report in PDF, a chained event trail and a sealed final package, as a ZIP file;
- public verification by QR Code, code or file.
2. Restricted pilot access
Access to Pactaris is granted on request, by e-mail to contato@firmaris.com.br. There is no public sign-up. During the pilot we may grant, deny, suspend or end access at our reasonable discretion. Features, limits and conditions may change with appropriate notice.
3. Nature of the signature and its limits
Pactaris offers simple electronic signature, with an evidence trail. The signer is identified by control of the e-mail address provided by the sender (individual link and one-time code). The service does not issue a digital certificate for the signer and is neither an advanced nor a qualified signature.
We do not promise that a simple electronic signature is sufficient or accepted for any purpose. The fit for your document and your case depends on the type of document, the applicable law and what the parties agreed. Documents that require a specific form are outside the scope of the service. It is up to you to assess that fit and, if in doubt, to consult your lawyer.
4. Evidence, seal and verification
For each request, Pactaris records the document's hash (SHA-256), the process events and the access data, and at the end seals the set with a digital signature over the manifest of the files. This makes changes detectable; it is not immutability. The seal does not identify the signer, is not a personal certificate and does not, by itself, prevent a file from being deleted or replaced. The recorded time is the server's, without a third-party trusted timestamp.
The single PDF (original followed by the report) is a convenience, generated when possible. To prove the content, the original file always prevails; it is stored separately and unchanged. We recommend downloading and keeping the final package.
5. Account and security
Access credentials are personal and non-transferable. The sender is responsible for keeping the password and the second factor safe and for reporting any suspected misuse immediately. Activity carried out with your credentials is considered yours.
6. Sender responsibilities
When creating a request, the sender declares and is responsible for:
- having the right to send the document and to process the personal data it and the request contain, on an appropriate legal basis, informing participants where necessary;
- providing each participant's name and e-mail correctly: whoever controls that e-mail is who will be able to sign;
- not sending unlawful, fraudulent, offensive or malicious content, nor using the platform to deceive third parties;
- assessing whether simple electronic signature is suitable for the document and the case;
- keeping the final package for as long as it is useful, subject to the retention described in the Privacy policy.
7. Participant responsibilities
Participants must read the document before signing, keep the link and the code under their control and not share them. Confirming the acceptance is a declaration of intent: anyone who disagrees must decline. Participants are responsible for keeping control of the e-mail address used to sign.
8. Availability and pilot
Pactaris is in a pilot. The service is provided as is, with no guarantee of continuous availability, and may undergo maintenance, changes or interruptions. Availability targets, support and other commercial terms will be defined by contract with each organization, where applicable.
9. Personal data
The processing of personal data is described in the Privacy policy, which is part of these Terms.
10. Intellectual property
The software, design and texts of the platform belong to Firmaris Group or its licensors. The content of documents remains with whoever sent it; the sender authorizes us only to process it to the extent necessary to provide the service described in these Terms.
11. Limitation of liability
To the extent permitted by law, Firmaris Group is not liable for damages arising from improper use of the platform, incorrect information provided by the sender, use of credentials by third parties due to failure to safeguard them, the choice of a type of signature unsuitable for the document, or the refusal of third parties or authorities to accept a simple electronic signature in a specific case. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Suspension and termination
We may suspend or end access in case of use contrary to these Terms, security risk or legal requirement. The sender may request that access be ended and data deleted, as described in the Privacy policy.
13. Changes to these Terms
We may update these Terms, especially on the move from the pilot to general availability. The version and update date appear at the top of this page.
14. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. The venue will be the one defined by contract with each organization or, failing that, the one provided by law.
